Terms of Use

These terms are an agreement between you and Allan Marquardt ("we", "us") for your use of the Hivie app. By using Hivie, you agree to them. If you don't agree, please don't use the app.
How we handle your personal information is explained in our Privacy Policy.
1. What Hivie is — and what it isn't
Hivie is a wellbeing companion: a place to talk to a friendly bee, check in with how you feel, read something kind and build small, gentle routines.
Hivie is not a medical or mental health service. It is not therapy, counselling or treatment, and it does not diagnose, treat or prevent any condition. Nothing in the app is professional advice. If you're worried about your health or your mental health, please talk to a qualified professional. Using Hivie is never a reason to wait before getting help.
Hivie is not an emergency service. If you are in crisis or in danger, contact your local emergency number. Free, confidential helplines in your country are listed at findahelpline.com.
2. Who can use Hivie
You must be at least 16 years old to use Hivie. By using it, you confirm that you are.
3. Your account
You can use Hivie without creating an account: the app creates an anonymous one for you automatically. Without an account, your data lives on your phone, and it may be lost if you delete the app or lose your phone.
If you create an account — with an email address and password, with Google or with Apple — you're responsible for keeping your sign-in details secure and for what happens under your account. Tell us at [email protected] if you think someone else has accessed it.
You can delete your account at any time from inside the app (Profile → Account → Delete account). This permanently removes your data from our servers, as described in the Privacy Policy.
4. Hivie Plus
Hivie is free to use. Hivie Plus is an optional subscription that lifts the free version's limits and adds extra features.
- Plans and prices are shown in the app before you buy. They may vary by country and include any applicable taxes.
- Payment is charged to your Apple ID account when you confirm your purchase.
- Free trial. Where a free trial is offered, it becomes a paid subscription when it ends unless you cancel at least 24 hours before the end of the trial. If you buy a subscription during a trial, any unused part of the trial ends.
- Automatic renewal. Your subscription renews automatically for the same period and at the same price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
- Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID account settings. Cancelling stops future renewals; you keep Plus until the end of the period you've already paid for.
- Refunds are handled by Apple, under Apple's policies. We can't issue refunds for App Store purchases ourselves.
- Price changes. If the price of your subscription changes, you'll be told in advance, as Apple requires, and you can cancel before the new price applies.
What's included in the free version and in Hivie Plus may change over time. If a change significantly reduces what you've paid for, you can cancel your subscription.
5. Talking to Hivie
Hivie's replies are written by artificial intelligence. They can be inaccurate, incomplete or not right for your situation, even when they sound confident. Hivie is a character, not a person, and she has no professional knowledge of your circumstances.
Please use your own judgement with anything Hivie says, and don't rely on her replies for medical, legal, financial or other important decisions.
To help keep people safe, messages are checked automatically for signs of crisis. When one is detected, Hivie replies with a fixed message pointing to real help instead of an AI-written reply.
The free version includes a daily number of messages. Hivie Plus lifts that limit, subject to reasonable use that protects the service for everyone.
6. Using Hivie responsibly
Please don't:
- use Hivie for anything illegal, or to harm, harass or threaten anyone;
- try to make Hivie produce harmful content, or to get around her safety features;
- access, or try to access, other people's data, or interfere with how the service works;
- use bots, scripts or other automated means to use the app, create accounts or send messages;
- copy, reverse engineer or resell any part of the app, except where the law allows it.
We may suspend or end access for anyone who breaks these rules, or who puts the service or other people at risk.
7. Your content
What you write in Hivie — your messages, mood notes, bottle messages and anything else — is yours. You give us permission to store, process and transmit it only as needed to run the app for you, as described in the Privacy Policy. That permission ends when you delete the content or your account, except for copies in backups, which are removed on the schedule described in the Privacy Policy.
8. Our content
Hivie — including the character, name, logo, illustrations, phrases, text, design and software — belongs to us or our licensors and is protected by intellectual property laws.
We give you a personal, non-exclusive, non-transferable and revocable licence to use the app for your own non-commercial purposes, on Apple devices you own or control, as allowed by the App Store's Usage Rules. You're welcome to share phrases from the app using its share feature.
9. Changes to Hivie
We keep improving Hivie, so features may be added, changed or removed. We may also suspend or discontinue the app. If we discontinue it, we'll try to give you reasonable notice.
10. Ending your use
You can stop using Hivie at any time, and delete your account from inside the app. We may suspend or end your access if you break these terms, if the law requires it, or if we discontinue the app. Sections that by their nature should continue after that — such as ownership, disclaimers and limitation of liability — continue to apply.
11. Disclaimers
Hivie is provided "as is" and "as available". To the fullest extent the law allows, we make no promises about the app beyond those in these terms — including that it will always be available, free of errors or suitable for a particular purpose.
12. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for any loss of data, profits or goodwill, arising from your use of Hivie. Our total liability for any claim related to Hivie is limited to the amount you paid for Hivie Plus in the 12 months before the claim, or USD 50 if you haven't paid anything.
Nothing in these terms limits any liability that cannot legally be limited, such as liability for death or personal injury caused by negligence, or for fraud. If you're a consumer, you keep every right that the consumer laws of your country give you, and nothing in these terms affects them.
13. Apple App Store terms
If you downloaded Hivie from the Apple App Store, the following also applies:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Hivie and its content.
- Your licence to use Hivie is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We are solely responsible for providing maintenance and support for Hivie. Apple has no obligation whatsoever to provide any maintenance or support.
- If Hivie fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Hivie.
- We, not Apple, are responsible for addressing any claims relating to Hivie or your use of it, including product liability claims, any claim that Hivie fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Hivie or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using Hivie.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, will have the right to enforce them against you as a third-party beneficiary.

14. Governing law
These terms are governed by the laws of Chile. If you're a consumer, this doesn't take away the protection of the mandatory laws of the country where you live, and you can bring proceedings in the courts there.
Before going to court, please write to us at [email protected]. Most problems can be sorted out that way.
15. Changes to these terms
We may update these terms from time to time. We'll change the date at the top, and if the change is significant, we'll let you know in the app before it takes effect. If you keep using Hivie after that, you accept the updated terms. If you don't agree, you can stop using Hivie and delete your account.
